nbc bay area news starts now. >> good morning, everyone. thanks as always for joining us. i'm jon kelley. marla tellez has the day off. happening right now, crews are starting to finally gain some ground on the wild fire burning out in yosemite. it is 15% contained. that is up monumentally. that is up 7%. so far we can tell you nearly 150,000 acres have burned. that's roughly for perspective here about the entire size of the city of chicago and crews are working very hard to protect 4500 structures including some homes out there. among the buildings already destroyed, the berkeley tuolumme camp. nbc bay area's jay gray is live

with the latest from the front lines. jay, this has been rough all!/ e way around. >> yeah, it has, jon. while progress is being made, not near enough at this point. you can see the thick smoke hanging in the air here. small towns like this one really literally in the line of fire right now. this area serving as a base camp for the crews trying to hold the flames back. >> as the sun pushes through the smokey haze it reveals signs of the fire and the fight this morning in northern california. teams rotating in for their turn on the front lines of the fire that's already charred close to 150,000 acres and now threatens more than 4,000 homes. >> we've got a serious situation going on here. they're going to be our heroes. >> heroes throwing every weapon they can at the massive fire, as the flames inch closer to several communities along the western edge of the blaze. >> it is continuing to grow in

that direction, albeit at a slow rate. they're doing a lot of work with fire lines and contingency lines in case those lines fail, dropping a lot of air retard dants and buying the firefighters time. >> 3400 firefighters on the ground now with more expected to join the fight. >> yeah. they'll need as many crews as possible here as the fire is pushed by strong winds continues to spread in all directions. that's the latest, i'm jay gray. thank you very much. thank you very much. governor jerry brown has declared a state of emergency. today he's planning on being up there meeting with firefighters. what can you tell us? >> we know they're going to meet behind closed doors. he's going to get a briefing on where this fire is going, what they have control of and what they expect as they move forward here. he'll talk with those officials behind closed doors and come out and talk to the media here, give us an assessment of the effort here. it's one that obviously is monumental more than 3600 firefighters on the ground right

now. more expected to pour in as this fight continues and should continue for quite some time, jon. >> jay, thank you very much. we'll check back in as the week progresses. appreciate it. the question is will weather be helping out the firefighters in this battle. christina loren, it sounds like thunderstorms are heading into the area? >> yeah, tuesday into wednesday, jon. let's talk about what's happening out there right now. we'll talk about the improvement that we are expecting due to some showers coming in tomorrow. 24 hour forecast shows you the winds have shifted, 15% containment. south southwest wind direction. that is an on shore breeze. no dry winds anymore. coming from the pacific and moving all the way into the area. as we head throughout the next 24 to 48 hours, it is going to start to get a little bit dicey. when it comes to thunderstorms, we could see lightening spark new fires. however, a bigger component are the showers we expect. the future cast, tomorrow monsoonal moisture will come up

into the rim fire area and help out the firefighters battling the blaze. we'll have another round of showers in the area. we could see some improvement from mother nature. here in the bay area, one of the only areas across the entire bay area without any active fires. we'll take a close look at the local forecast. >> christina, see you in a few moments. for continuing coverage of the rim fire, website nbcbayarea.com is updated. you'll find a link to an interactive map that shows the perimeter of that fire. all you have to do is search rim fire. to other news now, a former child psychiatrist from san mateo who pleaded no contest to molesting boys in the 1990s will find out his sentence. christine smith is live in redwood city right now. she's been following the court case. >> good morning to you. right now victim impact statements are being read in a

packed courtroom. at least 11 people have signed up to speak including one man who stood up in the court and looked directly at william ayers and said, you're disgusting. what you did was horrible. now ayers, the former child psychiatrist in san mateo sat in a wheelchair with shackles on his waist and didn't speak at all. he tried to withdraw his no contest plea but today a defense motion had proceedings suspended on the basis of being incompetent was denied by a judge. the mental status of the 81-year-old has been a big factor here ever since the first trial ended in a hung jury. then there were other questions whether he was able to help in his own defense. in court one alleged victim told him forgiveness is only for those who are willing to change repeatedly calling him a serial pedophile. he faces anywhere between 8 and 22 years in prison.

reporting live in redwood city, christ yi smith, nbc bay area news. as always, appreciated, christie. vectoinvestigat inves gators are looking at a video. >> reporter: it was across sfrt scene of this murder that captured gunmen shooting down this man saturday afternoon in downtown san jose. by showing you snippets of this tape, perhaps you can help police at headquarters capture the suspected gunmen. now twee have edited the video to show you the moments before and after the shootings and perhaps you can see them. you see the victim rise in the frame on a bicycle, pulls into a parking lot at third and julian streets, gets off his bike trying to run away as a gunman chases him down. that gunman hits him and shoots him at least once. you see the man falling down

between the two vehicles. seconds later another man on a bicycle rides up, gets off his bike and witnesses tell us fires more shots at the victim and then he fleas on his bicycle. at that point several people run to try to help the man. they call police, unfortunately he does not survive his wounds. we spoke with the victim's aunt. she wants people to know her nephew was a good person. >> he's a good guy. six kids, really young. he didn't deserve this. he didn't deserve it at all. we love him though. >> this is video again of the scene from the parking lot at third and julian. family and friends have left flowers and candles in honor of this man. police have not yet released his name. is he the 33rd person to be killed within the city of san jose1q!%m year. if you compare it to last year, not quite there at the end.

>> four people this morning. he was shoot in oakland, police say a mother along with her daughters, 8 and 12 years old, were involved in a shooting on 104th avenue near international. the 17-year-old boy who was the intended target was also shot in the leg. all four victims were happy to report and are expected to be okay. police did not yet made any arrests in this case. if you happen to have any information you're asked to please call oakland police. the opd says it has one more place to look as they continue searching for oakland toddler daf any webb. the crews searching the area over the weekend using cadaver dogs. daphne webb was last seen july 10th. family members believe she is still alive. now this weekend's search, it came up empty, but officers, they say they have another area that they intend to search. there is a $20,000 reward in

this case. on the international scene, the u.n. inspection team arriving on scene of last week's chemical attack in syria. the inspectors are regrouping after one of their vehicles was targeted by gunfire. nbc's richard engel traveled 3( heard locals say they're concerned more chemical attacks could be on the way. >> we have now returned to turkey, but we just left syria. that is the entrance to the syrian border behind me. and when we were inside we spoke to syrians who are absolutely desperate calling on the united states to intervene militarily. war, this is a war among syrians. they don't want the united states on the ground. they don't want this to become another iraq, but they say unless the world's super power intervenes militarily after what many countries highly suspect was a chemical weapons attack by the syrian government, unless the united states acts now it will only encourage bashar al

assad's regime to take more drastic steps and perhaps use chemical weapons again. the syrian government denies that it ever used chemical weapons. when we were inside we saw a family that had just left their town that was being shelled because they were afraid that among the shelling there might be another chemical weapons attack. we went to a hospital where the doctors and nurses were putting to the very rudimentary clinics to receive potential victims of chemical attacks. these were basic clinics. just a hose to wash off any chemical substance, one gas mask, viles of atropin. they weren't ready to receive mass casualties. thank you very much. coming up after this break, a monumental honor for a local hero receiving america's highest military honor. a stock exchange merger and a super model all ahead in business and tech. before that, which mtv video

these two individuals stole luggage from other flights that were diverted there after the deadly crash in july. prosecutors say thomas took clothing from the bags to a nordstrom's store and then got $5,000 for those items. more stolen items were allegedly found inside that couple's home. also some san francisco police officers hit the streets sporting a new piece of gear that's in the form of a video camera. those cameras will be strapped to officer's chests when they conduct search warrant checks for alleged illegal searches stemming from a 2011 video. police chief greg serve says the addition of the new cameras will help reduce citizen complaints

and are supposed to be used during searches. big changes in the world of stocks and more bad news. scott mcgrew says the nasdaq is about to be eclipsed. >> two exchanges, we rarely talk about backs and direct edge. now together they will have the stock exchange in the united states. that's bigger than the nasdaq. the floor of the new york stock exchange. that, too, is largely going electronic. i'm showing you this video that i can't show you the back exchange because the back only exists inside computers. there's nothing to take a picture of. in fact, you know that ceremony we show you from the nasdaq, that's there in the sense of there's no need for the opening bell. everything's done by computer. that does leave us with the new york stock exchange which still

could be hitting a roadblock. according to the chronicle, repair costs for peers to hold that venue. that was increased by as much as $50 million. month-long delays could cause the team to miss it. . representatives for the warriors deny these reports. it's planned to be 20 and 32 and it would serve the arena and also as a concert venue. a bay area native is receiving america's highest military award. that is happening as we speak. here's a live look at the white house. president obama will soon step up there to honor army staff sergeant ty carter of antioch with that medal of honor. you can see the media and friends gathered there. here's the story. back in 2009300 insurgents attacked a remote army post in afghanistan. carter dancing in harm's way fought back risking his life to

the temperatures, we are in the 70s in wine country. wine country, it is really popular this time of year especially as we get into the upcoming weekend. temperatures are going to be really comfortable. 69 degrees in napa. 65 down in the south bay. can't beat that in san jose. who needs the ac when we have the natural coolant. temperatures 71 degrees in santa cruz. we'll hit 72 as the high. you can't beat that if you want to hit the beach. this is one of the only parts. entire state where we are not dealing with any active fires. so, yes, we've been very lucky, very blessed in the bay area. coastal fog and drizzle. widespread low clouds on the way. slightly warmer afternoon. good air quality. temps start to cool off. tomorrow will be the warmest. i want to stop the clock and show you why. stop that clock for you again. getting into your wednesday

the first time in nearly half a century since the vietnam war that we've been able to present the medal of honor to two survivors of the same battle. indeed, when we pay tribute to clint romashea, we paid tribute to he and his team who provided down in their humvee. the medal we present today to ty carter is the story of what our troops do to each other. as some of you may recall, scott keating was not just one of the most remote outposts in afghanistan, it was also one of the most vulnerable. on low ground, deep in a valley surrounded by towering mountains. when soldiers like ty arrived they couldn't believe it. easy targets for enemies in the

underscores that there are always contingencies out there, things you don't like to expect. well, we've got some extra money, let's go spend it on one program or another. we do have to keep a decent reserve so when the unexpected happens, we're ready for it. so we don't -- this is august. what's going to happen in september in terms of fires? we don't know, but i'm sure they're going to cost us money and the state of california has that money because we've cut. we had cuts but there's plenty of call on the resources. but fire safety is right at the top. >> governor, can i ask you about firefighters' safety. this is on the heels of the terrible tragedy in arizona. you have nearly 4,000 firefighters on the line with this thing. what are your concerns? what are your orders to the commanders in terms of making sure that the priorities are straight and firefighters are safe? >> well, we've got a good team

here. they're doing everything they can to fight the fire and fight it safely. i'd rather ask you about the safety. go ahead. >> thank you, governor. obviously firefighter safety is one of our top priorities. firefighters understand the risks they place themselves in harm's way to protect life and property, but our first priority is to give them a fighting chance to do that safely. so we are very positive that there are very few injuries on this fire. we want to keep it that way. we also recognize. there is not a history of fatality fires in the last 30 years. we are very positive. we're concerned about the fire behavior here. we're going to take care of it. >> okay. anything else? all right. >> let me ask you about the water plight of san francisco, governor. you talked about the power

concerns. what about the water concerns for san francisco? >> the water concerns, it goes r on. all of the ash and the debris under the water, the water gets contaminated, that's bad. whatever the firefighters can do to prevent that, more action will be taken. >> clear your property. everybody needs to be aware. second of all, the government has a very important role to play. that takes money, and we have the resources, but we have to spend what it takes. we'll have a worst disaster than we already have. californians have real talent and great expertise to fight fires, but it takes money. it's going to take more money before we get finished. we're going to have to ask the presid
